We only work on the basis of the German Freight Forwarders’ Standard Terms and Conditions (Allgemeine Deutsche Spediteurbedingungen,
ADSp 2016).

Section 23 of the ADSp limits the statutory liability for damages to goods of 8.33 Special Drawing Rights (SDR) per kilo as defined
in Section 431 of the German Commercial Code (HGB) to EUR 1 million and the higher of EUR 2 million or 2 SDR per kilo for each case of loss or loss event respectively, and for multimodal transport generally, including transport by sea, to 2 SDR per kilo.

Clause 27.1.1 of the 2016 ADSp is extended to the benefit of the client so that the disclaimers and limits mentioned in clauses
22.2, 22.3, 23.3 and 23.4 in conjunction with clauses 23.5 and 24 of the ADSp do not apply if the damage has been caused by the deliberate action or gross negligence of the freight forwarder or its agents.
